Need info on common-law marriage in Australia?

We Answered:

In Australia the term de facto marriage is often used to refer to relationships between men and women who are not married but are effectively living as husband and wife for a period of time, however common-law marriage is sometimes heard. The Federal parliament has power to legislate for marriages, which it first did in 1959 with respect to divorces and separation with the Matrimonial Causes Act (covering divorces, etc.) which has now been replaced by the Family Law Act, 1975. The Marriage Act, 1961 provides for the formalities required for a lawful marriage. The Marriage Act does not recognize 'common law marriages'. The Federal parliament has no power over de-facto marriages, and thus all Australian states and territories have legislation covering aspects of de-facto marriages, such as property distribution, and spouse maintenance if a relationship ends (however children born out of wedlock are covered by the Family Law Act 1975 as a result of the states remitting this power to the Commonwealth). Most laws dealing with taxation, social welfare, pensions, etc. treat de-facto marriages in the same manner as solemnized marriages.

My understanding is that the laws are different for each state or territory. Might find more info on google, just search australia+common law marriage

Hope this helps

Factors necessary for a change in law and an example?

We Answered:

the growth of same-sex relationships and the resulting pressure for rights similar to married couples

In November 2008, the Australian Parliament passed laws that recognised same-sex couples in federal law, offering them the same rights as unmarried heterosexual couples in areas such as taxation, social security and health, aged care and employment

Which is the best University in Australia in the field of Law?Any URL's of such University will be appreciated

We Answered:

G'day,

There are only 39 universities in Australia, therefore the quality and recognition of their graduates are equal from wherever university you are studying from. The most important thing is you have to READ the course information carefully, since some courses may have the same name but different content.

To find out the law course that you are taking and where it is offered, I suggest you to go to IDP Education Australia website (www.idp.edu.au). IDP is an organisation that gives information to international students who wants to continue their study in Australia. Once decided on the uni, fill in the application form and send it together with certified copy of your academic qualification (in English and original language).

Job prospects... well you will need to find your niche in the lawyer market, ranging from family, immigration, property, business even taxation laws. Once you find your 'specialty', then it's easier to focus your job priority.

Hope this helps. E-mail me at mikegun@studentfirst.com.au if you have more queries abt studying in Australia. Good luck for your study and welcome to Australia :)

How is the quality of life in Australia?

We Answered:

Australians enjoy an excellent quality of life - well up with the best in the world. We live in a fantastic climate in a beautiful, clean, safe, uncrowded, developed country.

Women have full equality here and are treated very well by society as a whole though some individuals have their problems with partners. There are very strict and well enforced laws against gender discrimination.

When all taxes (state, sales, income, property etc) are taken into account, Australia’s level of taxation is fairly similar to those of the US and when our universal healthcare, subsidized pharmaceuticals and other social benefits are considered, we’re better off than US taxpayers.
.
We have one of the best healthcare systems in the world. Medicare is universal healthcare paid for by taxation and a Medicare levy paid by all taxpayers. It isn't nationalised or socialist healthcare: all non-hospital based doctors are privately employed (never by health insurers)or self employed and we can choose which doctor/s we attend. All care in public hospitals is completely free to all citizens and permanent residents. Many people also have private health insurance because they prefer private hospital care but even that is heavily subsidised by the government

I'm a bit old to answer the guy question, but there seem to be plenty of nice ones about.

University tuition is heavily government subsidised but is not free. Interest free, non-means tested payment deferment (repaid thorough the taxation system when earnings reach a certain level) is provided by the government if required and a Youth Allowance is available to independent students and those from low income families.

Australians generally like and welcome Americans as individuals but some may have issues with US government policies. The election of your new administration has greatly reduced those issues.

I guess all governments have the odd corrupt official and we're probably not immune, but Australia has no known government corruption. We don't particularly admire them, but they're a pretty honest lot and bribery is unheard of. There is definitely no entrenched official corruption. Your Ad Here
